Photo Contest – IndiaShots.com

Recently I came upon a Photo Contest on India as a theme. I was intrigued.

Open to all, free to upload Check – www.indiashots.com. This Contest Site is a product of www.bigappledesigns.com and whose another product site is www.royaltyfreedisc.com!

What does it all that mean?
You upload your best pictures (its a contest after all!) and thereby give the site permission to use your picture in any context by IndiaShots – and is not limited to IndiaShots’ advertising or promotional purposes. 

Read the fine print of the Contest rules prior to uploading your pictures on IndiaShots! Your pictures may be used as Stock pictures by IndiaShots for any purpose as deemed necessary by them.

I wonder why not?
Limit the rights on the photographs to the use of contest and contest related promotional/ advertising materials in any media but always explicitly linked to IndiaShots Contest true to the manner in which it was submitted, and always acknowledging the photographer?

  1. IndiaShots.com is a contest mainly for amateurs. It does not ask for an exclusive license to a photo. The non-exclusive rights asked for are standard terms for any photo contest. Photos submitted to the contest are not going to be re-sold anywhere else and are for use only by IndiaShots.com. Please see the FAQ that answers this question. If you had any idea about what Royalty Free photos are, then you would not be publishing this uniformed article. One cannot sell a Royalty Free Photograph without exclusive rights to re-sell a photo.

    IndiaShots explicitly mentions –
    All entrants agree to provide IndiaShots a royalty-free, perpetual, Non-Exclusive, world-wide license to display, reproduce, distribute and create derivative works of the entries in part or in whole for use in, but not limited to advertising and promotional works. This usage will not be restricted to any type of media. Photo submissions may also appear in IndiaShots and will include photographer credits. IndiaShots will not seek additional permission or be required to pay additional consideration for such uses to the photographer.

    1. The agreement allows IndiaShots to – …world-wide license to display, reproduce, distribute and create derivative works of the entries…
    2. The agreements says – ..Photo submissions may also appear in IndiaShots … – Does not state the photos will surely not appear elsewhere.
    3. Isn’t IndiaShots and RoyaltyFreeDisk part of the same company?

    IndiaShots is also listed on this site, http://currentphotocontest.info/index.php?/categories/6-Amateurs – Contradictory to your comment, many contests have much cleaner copyright statements.

    I would encourage IndiaShots to make a more ‘amateur photographer’ friendly agreement – that explicitly rules out any usage beyond that of the contest.

    You have made the following incorrect statements on your website:

    INCORRECT STATEMENT ONE:
    “Fine print of the Contest rules gives the complete proprietary rights of the uploaded photos to be to IndiaShots!” – We do not want complete proprietary rights nor have we asked for it anywhere.

    We ask for Royalty Free Non-Exclusive rights only. This is a norm for any photo contest. Royalty Free photos by definition cannot be re-sold.

    INCORRECT STATEMEMENT TWO:
    “Well, why all the fine print? Why don’t they tell you upfront that your picture may be sold as Stock pictures?”

    There is no way we or any law abiding firm can re-sell a non-exclusive use photo as a stock photo. What you write is pure conjecture.

    You should retract your false statements and take greater care before engaging in slander. Not understanding legal language is one thing – but making seriously false misrepresentations is a serious matter.

    I just happened to see your blog on photo contest and got to know the hidden side of posting photos to these websites. What they are doing is outrageous – no doubt!

    Your blog made me check the terms and conditions on PICASA and guess what – they too are no different!!! (Please check point no:11 mentioned in the link http://google.com/accounts/TOS?hl=en_US)

    I will not post anymore photos on Picasa!
